Oversight: Spelinspektionen or the Malta Gaming Authority
A casino with a Swedish licence is supervised by Spelinspektionen (the Swedish Gambling Authority), which enforces the Swedish Gambling Act (2018:1138) and the law on measures against money laundering and terrorist financing. The authority is based in Strängnäs and aims for a sound and safe gambling market with a social safety net. If a licence holder breaks the rules, the company risks sanctions and, in the worst case, having its licence revoked. Spelinspektionen also points out that a Swedish licence is no guarantee that a company follows the rules; that is exactly what the oversight is there to check.
An MGA casino falls under the Malta Gaming Authority (MGA). According to the authority itself, its mandate is to regulate the gaming sector competently by ensuring games are fair and transparent, preventing crime, and protecting minors and vulnerable players. The framework consists of the Gaming Act and regulations such as the Gaming Player Protection Regulations, supplemented by directives such as the Player Protection Directive and the ADR Directive. The MGA can investigate and take action when a company fails to follow the rules.
A Swedish licence and an MGA licence are two separate matters. A Maltese licence does not replace a Swedish licence where a Swedish licence requirement applies, and a company can hold a Swedish licence for some domains but not others. Always check the exact domain: Swedish licences in Spelinspektionen's licence register and Maltese ones in the MGA's register.
Spelpaus, self-exclusion and gambling limits
This is where the difference is greatest. A self-exclusion on Spelpaus.se covers all gambling that requires registration at every company with a Swedish gambling licence: online casinos and online slot machines, betting, online bingo and lotteries, gaming terminals and games at agents. You choose 10 days, 1, 3 or 6 months, or indefinitely, where indefinitely means at least 12 months. A confirmed self-exclusion cannot be ended early. Swedish licence holders must also let you self-exclude directly with the company, and for online casino games, also immediately for 24 hours.
MGA casinos are not covered by Spelpaus, so a self-exclusion you have set up in Sweden does not carry over. The MGA instead describes self-exclusion with the operator. With a Swedish licence, Swedish legislation applies if a win is not paid out.
